TERMS OF AUCTION
 

The auction is carried out on behalf and for the account of the owners in compliance with the legal provisions of the BGB and HGB resulting from the Auction Ordinance (BGBII 1976, 1346) and applicable to commission agents against cash payment of the purchase price in EU currency. By submitting a bid, the auction conditions are accepted.


The hammer price forms the basis for calculating the premium of 23% to be paid by the buyer. This includes the statutory VAT (goods subject to differential taxation). There is no ticket fee.


Foreign buyers from countries of the European Community (EC) will be charged the sales tax applicable in Germany. Other foreign buyers (from third countries) will be charged a surcharge of 20% net on the hammer price if the goods are exported by us; You will only receive delivery upon payment of the purchase price in EU currency, free of bank charges for us. Foreign stamp and coin dealers from EU countries will be charged a reduced premium of 17% upon proof of the sales tax identification number (§ 27a UStG) and the other requirements in accordance with § 4 No. 1b UStG in conjunction with § 6a UStG. For gold coins that are exempt from statutory VAT, a premium of 15% will be charged on the hammer price.


Unless otherwise agreed before the auction, payment of the purchase price is due from buyers immediately after the auction invoice has been issued in writing or via live bidding, telephone buyers (bidders). The auctioned items remain the property of the seller until all resulting claims have been paid in full. In the event of a delay, the auctioneer is entitled to charge interest (1% per month) from the invoice date.

The bid is accepted after the highest bid has been called three times and requires acceptance and payment. If there is any disagreement about the award, the number will be called out again. If payment is not made to the auctioneer or acceptance of the auctioned items is refused, the auctioneer loses his rights from the auction and the item can be auctioned again at his own expense. In this case, the bidder is liable for the shortfall in proceeds, but he has no claim to the excess proceeds. The auctioneer is entitled, but not obliged, to combine or separate numbers. Numbers are not taken in advance.

We represent the written and telephone advance bids with these minimum increases in an interest-preserving manner, whereby limits between these minimum increases are always rounded up. No liability is accepted for difficulties that arise due to technical problems in connection with the platforms.

Orders from prospective buyers unknown to us are only entitled to execution if a deposit is deposited or verifiable references are provided. If there are several equal bids, the one received first will be given preference. Unlimited orders are not entitled to unconditional execution and will be executed up to a maximum of ten times the estimated price. Viewing broadcasts cannot be made. Shipping costs, postage and transport insurance are borne by the client or recipient. The shipping risk still remains with the buyer if the shipment cannot be adequately insured (especially shipping abroad).

The description in the catalog has been carried out with care and to the best of our knowledge and belief. However, it does not establish any legal or material liability in accordance with BGB § 434, 459ff. If the buyer returns the goods purchased from us, e.g. If you want to submit the item for inspection to a philatelic examiner on the BPP list or an equivalent person, the auctioneer's prior consent is required. The costs will be borne by the buyer unless otherwise agreed in advance. Any changes, e.g. signing the object or cleaning it, are excluded; the term “counterfeit” or similar is not considered a change. There is no delay in the payment deadline based on the check. The description of the condition such as cabinet, splendor, etc. are personal classifications and cannot be complained about. Catalog values ​​are always approximate and are non-binding

Collections and lots and individual lots viewed are auctioned as is; the latter can only be complained about by inspectors with justified reasons.

Reasonable complaints can only be taken into account within 10 days after the auction or after receipt of the auctioned items. The auctioneer reserves the right to exclude people from the auction for special reasons. Price agreements between bidders are expressly prohibited. They result in immediate exclusion from the auction. A contractual penalty of 3,000 euros applies to each case of violation. The same also applies to unauthorized trading in the auction room and during the viewing.

As long as the catalog owner, auction participants and bidders do not express themselves to the contrary, they assure that they will use the catalog and the contemporary and military historical objects from the period 1933-1945 contained therein only for the purposes of civic education, the defense against unconstitutional and anti-constitutional efforts, scientific and art historical Research, education or reporting on current events or military-historical and uniform-related research (§86a StGB). The company Münzzentrum Rheinland, Heinz-Willi Müller, as the auctioneer and its consignors only offer these items under these conditions.

By placing bids for items that bear emblems of the Third Reich, the bidder undertakes to purchase these items only for historical and scientific purposes for the reasons mentioned above and in no way for propaganda purposes, especially within the meaning of §86a StGB to use. The auction house tries not to offer such things at all.

The prices listed in the catalog are non-binding estimates. The call is made on average at 90% of the estimated price, unless at least two higher written bids have already been received. The winning bid can therefore be either below or above the estimated price, depending on the amount of bids submitted in writing, by telephone or via live bidding.

We will not accept written orders that are less than 90% of the estimated price.

There is no ticket fee. The place of jurisdiction and place of performance for resellers is Solingen, otherwise the place of jurisdiction is the place of legal regulation.

The list of results will appear after the auction at a price of 3 euros including postage and must be paid in advance if no further calculations are pending. We ask that you request this when placing the order. Individual results cannot be communicated. Publication on the Internet will take place as soon as possible.

The knock-down price is the basis for the calculation of the buyer`s surcharge. For buyers from EEC countries the following
applies: for consumers there is a standard surcharge of 23 % (relevant VAT already included). For traders according to the
Value Added Tax Act the surcharge is 23 % (relevant VAT already included) for goods delivered by difference taxation; for
goods delivered by standard taxation the surcharge is 20 % plus the relevant VAT on the entire amount of hammer price and
surcharge.
Purchasers from abroad will be charged a surcharge of 20 % net on the knock-down price, provided the export of the coins
ist undertaken by the auctioneer. Buyers in European Community (EEC) countries (other than Germany) will be charged
Value Added Tax at the rates prevailing in Germany.
Dealers from EEC countries (other than Germany) will receive goods free of tax upon presentation of their VAT I.D. number,
and upon ful fillment of the other conditions set forth in Paragraph 4, Nr. 1 b, and Paragraph 6 a of the German Turnover Tax
Law, they will be charged a surcharge of 17 %.
For gold coins, which are not subject to the legal VAT , the surcharge is 15 % of the hammer price.
